Terms of Use

These Terms of Use (“Terms”) govern your use of the Tanken app and the website at tanken.sg, operated by Curiosidad Pte. Ltd. (“Curiosidad”, “we”, “us”, “our”), a company based in Singapore. By downloading, accessing or using Tanken, you agree to these Terms. If you do not agree, please do not use Tanken.

1. Who can use Tanken

You may use Tanken only if you can form a binding contract with us and are not barred from doing so under any applicable law. If you are under 18, you should use Tanken only with the involvement of a parent, guardian or school that agrees to these Terms on your behalf. Tanken is not available where its use would be prohibited by law or by trade sanctions.

2. Your account

To use Tanken you create an account, which you can do with a one-time email link or by signing in with Apple, Google or Facebook. You agree to provide accurate information, to keep your sign-in details secure, and that you are responsible for activity that happens under your account. Tell us promptly at support@curiosidad.sg if you think your account has been used without your permission. We may suspend or close an account that breaches these Terms.

3. Using Tanken safely

Tanken guides you to walk through real places. Your safety is your own responsibility. When you follow a trail, you agree to:

• stay aware of your surroundings, including traffic, other people, and the condition of paths and stairs;
• obey all local laws, signs and instructions, and respect private property, closed areas and the people and places you visit;
• use your own judgement about where it is safe to go, and not rely on the app for turn-by-turn or hazard-free navigation; and
• avoid using the app in any way that distracts you when it is not safe to do so, including near roads or water.

Trail routes and content are provided for general interest and guidance only. To the fullest extent permitted by law, you take part in trails at your own risk, and we are not responsible for injury, loss or damage arising from your use of a trail or the places it leads you to.

4. Acceptable use

When using Tanken, you agree not to:

• break the law, or infringe the rights of others;
• copy, scrape, reverse-engineer, or attempt to extract our content or source code, except as the law expressly allows;
• interfere with, overload or disrupt the service, or try to gain unauthorised access to it;
• upload content that is unlawful, harmful, misleading or that you do not have the right to share;
• impersonate anyone, or misrepresent your connection to them; or
• circumvent any access controls, paywalls or usage limits in the service.

5. Our content and intellectual property

The trails, text, images, audio, maps, design and software that make up Tanken are owned by Curiosidad or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the app and its content for your own non-commercial enjoyment. All rights we do not expressly grant are reserved. You may not copy, redistribute, sell or create derivative works from our content without our written permission.

6. Content you submit

Some activities invite you to submit content, such as photos, audio recordings or written answers. You keep ownership of what you submit. By submitting it, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, process, display and back up that content as needed to operate and provide the service to you.

You confirm that you have the rights to the content you submit and that it does not break the law or infringe anyone else’s rights. You are responsible for your submissions. We do not routinely review submitted content, but we may remove content that we believe breaches these Terms or the law.

7. Premium content and purchases

The first three points of any trail are free, so you can try it before you decide. To unlock the rest of a trail, you make a one-time purchase. Tanken does not use subscriptions, so there is no recurring charge, no renewal and no free trial to cancel. The price and what is included are shown to you before you buy.

• Billing. Purchases are processed through the Apple App Store or Google Play, and their terms also apply. We do not receive or store your card or bank details.
• What you get. A purchase unlocks the relevant content on accounts you sign in to. If you reinstall the app or change device, you can restore a previous purchase through the same app store.
• Price changes. We may change prices from time to time. A change never affects something you have already bought; it only applies to future purchases.
• Refunds. Refunds are handled under the policies of the app store you bought from. Nothing here removes any statutory consumer rights you have, including any withdrawal or refund rights for consumers in the EU, UK, Australia and elsewhere.
• SG Culture Pass. Tanken Premium is an approved SG Culture Pass experience. If you buy it with your Culture Pass credits, you do so through Pelago, and your booking is also subject to Pelago’s terms and the SG Culture Pass scheme terms. These purchases are non-refundable, and only eligible Singapore Citizens with SG Culture Pass credits can use this route; check the scheme’s own criteria at sgculturepass.gov.sg.

If you unlock Tanken with the SG Culture Pass, we may invite you to an optional post-walk survey and report attendance figures and collated, de-identified survey results to the Ministry of Culture, Community and Youth (MCCY), as the scheme requires. This applies only to SG Culture Pass participants; see our Privacy Policy for details.

8. Apple App Store

If you download Tanken from the Apple App Store, the following also applies and prevails over anything inconsistent in these Terms:

• These Terms are between you and Curiosidad only, not with Apple. Apple is not responsible for Tanken or its content.
• Your licence to use Tanken is limited to use on any Apple device that you own or control, as permitted by the App Store Terms of Service.
• Curiosidad, not Apple, is responsible for providing any support and maintenance for Tanken, and for addressing any claims relating to it, including product-liability, legal or regulatory claims, and claims that Tanken infringes someone’s intellectual-property rights. If Tanken fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for Tanken.
• You confirm that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you.

9. Third-party services and links

Tanken relies on, and links to, services we do not control, such as maps, sign-in providers, payment providers and external websites. We are not responsible for their content, availability or practices, and their own terms apply to your use of them.

10. Availability, changes and termination

We work to keep Tanken available, but we do not guarantee that it will be uninterrupted or error-free, and we may carry out maintenance from time to time. We may add, change, suspend or discontinue features, or the service as a whole. We may also suspend or end your access if you breach these Terms. You can stop using Tanken at any time, and you can delete your account and its data yourself using the self-service option in the app’s settings.

11. Disclaimers

Tanken is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose, or the accuracy, completeness or reliability of trail content. Trail information is provided for general interest and may contain errors or become out of date.

12. Limitation of liability

To the fullest extent permitted by law, Curiosidad will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of Tanken. Our total liability to you for any claim relating to Tanken is limited to the amount you paid us for Tanken in the 12 months before the claim.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under any non-excludable consumer-protection rights you have.

13. Indemnification

To the extent permitted by law, you agree to indemnify Curiosidad against claims, losses and reasonable costs arising from your misuse of Tanken, your breach of these Terms, or content you submit. This does not apply to the extent a claim results from our own fault, and it does not limit any statutory consumer rights you have.

14. Privacy

Your use of Tanken is also governed by our Privacy Policy, which explains how we handle your personal data.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the “last updated” date above. If the changes are significant, we will give notice within the app or by email. By continuing to use Tanken after the changes take effect, you accept the updated Terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction over any dispute, except where the mandatory consumer-protection laws of your home country give you the right to bring a claim there. Those mandatory protections continue to apply to you regardless of this clause.

17. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us about Tanken. If any part of these Terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right, that is not a waiver of it. We may transfer our rights and obligations under these Terms, for example as part of a business transfer; you may not transfer yours without our permission.
